Facts: | The defendant was stopped for weaving over the lane markers at least ten times over a two mile period. The officer noticed an odor of alcohol and slurred/mumbled/incoherent speech. Furthermore, the officer observed the defendant swaying as he stood, using his truck for support, and walking slowly. The defendant refused the roadside tests and the breath test. | |
